Laborde Law invites you to the 2022 edition of Paris Arbitration Week.
We will be hosting two events: one on the Opening Day, Monday, March 28; the other on the Closing Day, Friday, 1st April.
The March 28 event is focused on current big-picture issues in investment arbitration (1st panel) and Eastern Europe (2nd panel).
The April 1 event features a double debate: first, leaders of major arbitral institutions will discuss future challenges and trends, including climate change; second, we will host an Oxford-style debate: the UK v. France on the question of the law applicable to the arbitration agreement (inspired by the UK Supreme Court’s Kout Food judgment).

Current Big Picture Issues in Investment Arbitration

This panel will discuss the current big-picture issues in investment arbitration. First, what are the causes for the trend towards investment courts and away from investment arbitration (e.g. CETA, intra-EU, the MIC project)? Second, how, if at all, will the demise of intra-EU investment arbitration affect trans-EU arbitration? Third, should FET keep its place as the pre-eminent substantive protection standard in ISDS? Why or why not? Can the FET standard be improved upon?

Arbitration in Eastern Europe

The panel will discuss international arbitration trends and developments in Eastern Europe in recent years. It will also address three questions. First, how, if at all, have attitudes towards arbitration changed or evolved in the region? Second, what is distinctive about arbitrating in Eastern Europe or (or with Eastern European parties) compared to the rest of the world? Third, the elephant in the room: How will the current war in Ukraine affect the international arbitration landscape in the region?

Two Debates: Arbitral Institutions & Kout food: UK v France
Roundtable of Leading Arbitral Institutions

This panel brings together leaders of some of the world’s topmost arbitral institutions to discuss the state of affairs and pressing issues in international arbitration. The panel will address inter alia the following questions:

What are the main challenges facing international arbitration, and arbitral institutions, in the next decade or so? How can these challenges be met?

How will the practice of international arbitration evolve in the years to come?

Will the arbitral caseload increase, decrease or be about the same in the years to come? What novel arbitral areas will be real sources of new work (e.g. space, climate, new technologies, other)?

Expedited & emergency proceedings: How will they fare? Are they the future of international arbitration?

Climate change: Should the arbitration community aim for greener arbitrations (i.e. less carbon footprint)? If so, do arbitral institutions have a role to play in the pursuit of this aim? Is there room for collaboration amid institutions along the lines of something like the SIAC Cross-Institution Consolidation Protocol?

Oxford-Style Debate: UK vs. France on Kout Food

This panel features an Oxford-style debate on one of the most gripping and elusive questions in international arbitration: the law applicable to the arbitration agreement. According to the British motion, the law governing the contract governs the arbitration agreement (in line with the UK’s Supreme Court judgment in Kout Food). In turn, under the French motion, the law of the seat governs the arbitration agreement. Two teams will debate these conflicting positions.
